1. Agreement to Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and Marevane ("we," "us," or "our") regarding your use of our website and booking of snorkeling trips and related services.

By booking a trip, using our website, or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Continued use after modifications constitutes acceptance of updated Terms.

2. Definitions

  • "Service" means guided snorkeling trips, island stays, and related activities offered by Marevane
  • "Trip" means any day excursion or multi-day package booked through Marevane
  • "Guest" means any individual who books or participates in our services
  • "Agreement" means the booking contract formed when you confirm a reservation
  • "Force Majeure" means events beyond our control including weather, natural disasters, government actions, or other unforeseen circumstances

3. Eligibility and Capacity

To book our services, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter binding contracts under Malaysian law
  • Provide accurate and complete information during booking
  • Possess valid identification and travel documents

Participants under 18 must be accompanied by a parent or legal guardian who accepts full responsibility and agrees to these Terms on their behalf.

4. Booking and Payment

4.1 Booking Process

  • Bookings are confirmed upon receipt of required deposit
  • All prices are in Malaysian Ringgit (MYR)
  • Deposits are typically 30% of total trip cost for multi-day packages, 100% for day trips
  • Balance payment is due 14 days before trip departure
  • We reserve the right to cancel unpaid bookings

4.2 Payment Methods

We accept payment via bank transfer, credit card, and approved digital payment platforms. Payment processing fees may apply.

4.3 Price Changes

Prices are subject to change without notice. However, confirmed bookings will honor the price agreed at time of deposit, except for increases due to government-imposed taxes or fees.

5. Cancellations and Refunds

5.1 Guest-Initiated Cancellations

  • More than 30 days before departure: Full refund minus 10% administrative fee
  • 15-30 days before departure: 50% refund
  • Less than 15 days before departure: No refund

5.2 Weather-Related Cancellations

If we cancel trips due to unsafe weather conditions, you receive:

  • Full refund, or
  • Rescheduling to alternative dates without penalty

5.3 Force Majeure

Cancellations due to Force Majeure events entitle you to rescheduling or credit toward future trips. Refunds are at our discretion.

5.4 No-Shows

Failure to appear for scheduled departure without prior cancellation results in forfeiture of all payments.

6. Trip Modifications

We reserve the right to modify trip itineraries, routes, or activities due to:

  • Weather and sea conditions
  • Safety considerations
  • Marine park regulations or closures
  • Equipment or vessel availability
  • Insufficient participant numbers

We will notify you of material changes as soon as reasonably possible. Modifications do not entitle you to refunds unless the fundamental nature of the trip changes substantially.

7. Guest Responsibilities

7.1 Health and Fitness

You must:

  • Disclose any medical conditions that may affect participation
  • Be in adequate physical condition for water activities
  • Notify us of pregnancy or recent surgery
  • Obtain medical clearance if we request it based on disclosed conditions

7.2 Safety Compliance

You agree to:

  • Follow all guide instructions and safety protocols
  • Use provided safety equipment properly
  • Remain with your assigned group
  • Report any concerns to guides immediately
  • Refrain from alcohol or substances that impair judgment before activities

7.3 Environmental Responsibility

You must:

  • Use only reef-safe sunscreen
  • Avoid touching or disturbing marine life or coral
  • Follow marine park regulations
  • Dispose of waste properly

7.4 Conduct Standards

You agree to behave respectfully toward guides, other participants, and island communities. We reserve the right to remove guests whose conduct endangers safety or disrupts others, without refund.

8. Liability and Risk Acknowledgment

8.1 Inherent Risks

You acknowledge that water activities involve inherent risks including but not limited to:

  • Drowning or water-related injuries
  • Marine life encounters
  • Weather and sea condition changes
  • Equipment malfunction
  • Boat travel hazards

8.2 Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • We are not liable for injuries arising from your failure to follow instructions or disclosed risks
  • Our liability for any claim is limited to the amount you paid for the trip
  • We are not liable for indirect, consequential, or punitive damages
  • We are not responsible for third-party service failures (accommodation, transportation)

8.3 Insurance Recommendation

We strongly recommend you obtain comprehensive travel insurance covering medical expenses, trip cancellation, and personal liability. We are not responsible for costs not covered by your insurance.

9. Intellectual Property

All content on our website, including text, images, logos, and educational materials, is protected by copyright and trademark laws. You may not:

  • Reproduce or distribute our content without permission
  • Use our trademarks or branding
  • Create derivative works from our materials

You retain ownership of photos and videos you create during trips. By sharing content that identifies Marevane, you grant us a non-exclusive license to use such content for promotional purposes.

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By agreeing to these Terms, you also consent to our privacy practices.

11. Indemnification

You agree to indemnify and hold harmless Marevane, its guides, employees, and partners from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your negligent or intentional conduct
  • Your violation of applicable laws or regulations
  • Your failure to disclose relevant health information

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Malaysia. The courts of Kuala Lumpur, Malaysia have exclusive jurisdiction over any disputes.

12.2 Informal Resolution

Before initiating formal proceedings, we encourage contacting us directly to resolve concerns. Most issues can be addressed through communication.

12.3 Complaint Process

Complaints should be submitted in writing to legal@marevira within 30 days of trip completion.

13. Termination

We may terminate your booking and refuse service if:

  • You violate these Terms
  • You engage in unsafe or disruptive behavior
  • You provide false information
  • Your conduct threatens safety or violates laws

Termination for cause results in forfeiture of all payments.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Marevane.

14.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full effect.

14.3 Waiver

Failure to enforce any provision does not constitute a waiver of our rights.

14.4 Assignment

You may not assign your rights or obligations under these Terms. We may assign our rights to affiliates or successors.
